1. Explanation of the Rules of Procedure
Valid Value is not allowed to process the Data you provide to it without further ado. The Privacy Legislation is intended to protect the privacy of individuals. This legislation restricts the permitted use of your personal data by others. Under this law, Valid Value has a duty to provide its customers:
- Inform you of the manner in which and the purpose for which Data is processed by Valid Value;
- Notify who has access to the Data;
- Obtain consent for the processing of certain Data.
Your privacy is important to Valid Value. That is why Valid Value explains in these Terms and Conditions how it handles your Data, what the purpose of its use is and for the processing of which Data Valid Value must explicitly ask for your permission.
2. The Data used by Valid Value and the purpose of the use
Valid Value (may) process your personal data if you become or are a customer of Valid Value, are an employee of Valid Value or otherwise contact us (or one of our employees). Valid Value collects your name, address, telephone number and e-mail address. We also process the social security number of employees and managers and a copy of their ID. In addition, we process documents that you share with us that may contain personal data. We may report on this Data at an aggregated level, for example on salary costs per job group. This Data allows us to:
- To be able to handle the agreement that customers enter into with Valid Value financially and administratively;
- To be able to provide our services;
- To be able to reach customers or interested parties if necessary.
Data is sent from our software to our server, https://api.validvalue.com/ . The data that is sent/received:
- the license information/login information when launching the add-in
- User data: We collect error messages that arise in the model/add-in and store some basic user statistics. Under no circumstances does this concern data that the user enters into the models himself. The only exception to this is the data we need to provide support data (this is limited to country & sector on valuation date).
- Support data (as described above)
3. Disclosure of personal data to third parties
Valid Value does not provide personal data to any person or company outside the Valid Value organization, unless:
- That is required by a legal regulation;
- That is necessary for the performance of an agreement that Valid Value has entered into with you;
- You have given your consent to do so.
4. Obligations/secure access/confidentiality/retention period
Valid Value processes your personal data exclusively in accordance with the law. This means (among other things) that the Data is only processed for the purpose for which it was obtained and in a proper/careful manner in accordance with the law and these Regulations.
Your personal data can only be viewed by persons working for Valid Value, unless otherwise provided for in these Regulations. All your personal data is protected by Valid Value against unauthorised access. The security has the following components:
- Every person working for Valid Value has a personal password to log in to the digital system;
- The persons working for Valid Value have a duty of confidentiality with regard to all personal data provided to Valid Value;
- Valid Value has taken technical measures to protect the system it uses against external intrusions in accordance with the law.
Your personal data will not be kept longer than is necessary for proper administration. Valid Value applies a period of seven years after completion of our assignment, after which the Data will be destroyed. The law may prescribe a different retention period. If this is the case, Valid Value will comply with the prescribed statutory retention period.
5. Your rights as a data subject
- Right to information: the right to know whether and which of your personal data is being processed and for what purpose;
- Right of access: the right to inspect and obtain a copy of that data insofar as the privacy of another person is not harmed as a result;
- The right to correct, complete or delete Data if necessary (right to correction and deletion). The right to request (partial) deletion of your Data can only be fulfilled if the retention of the Data is not of significant importance to another person and the Data should not be retained on the basis of a statutory regulation;
- The right to object: the right to object to the processing of your Data in certain cases;
- The right to data portability: the right to receive the personal data held about you in order to be able to transfer it to another organisation;
- The right to a human perspective on automated decisions. In the case of an automated decision, there is the right to have the decision made by human intervention.
If you wish to exercise your rights, you can indicate this by email via info@validvalue.nl . If your request is denied, we will explain why. One reason may be that your file contains information that is or may be of interest to others. You will receive a message from Valid Value within one month of receipt of your request. If you have a complaint about the way in which your personal data is processed, you can also contact Valid Value and Valid Value will try to find a suitable solution.
